As of February 2009, New York State Association of Neuropsychologists (NYSAN) and the New York State Psychological Association (NYSPA) are working to correct the interpretation of the 2003 Scope of Practice Law, which does not allow for professional psychometrists to be utilized in clinical practice. Although clinical psychology graduate students may still work under the supervision of licensed psychologists, the inability to employ professional psychometrists in clinical practice has been extremely detrimental to many neuropsychologists in New York.
Although a non-legislative resolution is being pursued, Assemblyman Gottfried of the NY State Assembly is proposing a bill that would clarify this interpretation and allow for psychometrists to work in clinical practice.

NAP and its Board of Directors believe that the interpretation of the Scope of Practice Law needs to be changed so that it is congruent with the current standards of practice that allow neuropsychologists to employ psychometrists in clinical practice.

Bill Perry, PhD - NAN President - reported the New York State Psychological Association (NYSPA) has agreed in principle to overturn the 2003 decision banning the use of "technicians" (Psychometrists). Right now, the language of the legislation has to be drafted and then a legislative sponsor in the NY Senate must be identified who will attempt to put the bill through. There were some concessions that are unknown at this time. One of them, is that apparently only master's level "technicians" are able to administer and score "IQ tests." This is very odd since the WAIS-III is considered to be one of the most widely used instruments and was normed with the assistance of Bachelor's level psychometrists. Based this good news, NAP is postponing the claim mentioned below pending the final outcome of the NYSPA. Please stay tuned.

NY State Psychometrists (posted 11/8/07)
Dear Neuropsychology Colleague,
We need your help to overturn the New York State Psychological Association (NYSPA) decision that made the use of psychometrists (psychological technicians) is banned in the State of NY.
We want to file a complaint with the National Labor Relations Board (NLRB). To overturn this mandate we need to have psychometrists who have lost their jobs contact us so that we can file on their behalf a complaint with the NLRB stating that the employment of the psychometrist(s) was wrongly terminated due to the 2003 Scope of Practice Law.
The NLRB will review the claim and forward the information to the Department of Education who will in turn contact the NYSPA and require documentation supporting their decision to disallow the use of psychometrists did not violate state and federal labor laws. We are of the opinion the 2003 mandate violates these labor laws by excluding an entire occupation classification.
These charges often move to a federal level and it is likely the Department of Education will leverage their support onto the NYSPA to overturn their position.
Please have psychometrists who have lost their position in NY to contact Mike Malek-Ahmadi as soon as possible.
